THIS IS A LEGALLY BINDING AGREEMENT. IT INCLUDES A RELEASE OF LIABILITY, INCLUDING FOR NEGLIGENCE, AND AN INDEMNIFICATION OBLIGATION. READ IT CAREFULLY BEFORE ACCEPTING.
Assumption of Risk. I understand that electric surfboards, jetboards, and related equipment involve inherent and significant risks, including but not limited to: collisions with other participants, vessels, or fixed objects; falls; ejection from equipment; drowning; changing water and weather conditions; submerged or hidden hazards; contact with moving parts or propulsion units; equipment or battery malfunction; high-voltage battery systems; thermal events; and the actions or negligence of other participants and third parties. These risks can result in serious bodily injury, permanent disability, paralysis, or death. I VOLUNTARILY AND KNOWINGLY ASSUME ALL SUCH RISKS, KNOWN AND UNKNOWN, to the fullest extent permitted by Texas law.
Release of Liability — please read carefully
IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN OR BE PRESENT AT THIS ACTIVITY, I, ON BEHALF OF MYSELF, MY SPOUSE, HEIRS, EXECUTORS, ADMINISTRATORS, LEGAL REPRESENTATIVES, AND ASSIGNS, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE DIVINE VOLTAGE LLC, ITS OWNERS, MEMBERS, EMPLOYEES, INSTRUCTORS, AMBASSADORS, AGENTS, HOST VENUES, PROPERTY OWNERS, SPONSORS, AND AFFILIATES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION ARISING FROM MY PARTICIPATION IN OR PRESENCE AT THE ACTIVITY, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER FOR BODILY INJURY, DEATH, OR PROPERTY DAMAGE, TO THE FULLEST EXTENT PERMITTED BY LAW. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT, OR WHERE OTHERWISE PROHIBITED BY LAW.
Indemnification
I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY CLAIMS, DAMAGES, LOSSES, OR EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) ARISING FROM MY ACTS OR OMISSIONS DURING PARTICIPATION OR PRESENCE AT THE ACTIVITY, INCLUDING INJURY OR DAMAGE I CAUSE TO OTHER PERSONS OR PROPERTY, AND INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY LAW.
Covenant Not to Sue. I agree not to bring any claim released by this agreement. If I bring such a claim and it is dismissed or barred on the basis of this agreement, I agree to reimburse the Released Parties for the reasonable attorneys’ fees and costs they incur in defending it, to the fullest extent permitted by law.
Notice of Injury. I agree to report any injury, incident, near miss, or equipment problem to Divine Voltage staff before leaving the site, and to provide written notice of any claimed injury to Divine Voltage LLC, 6301 Iris Run, New Braunfels, TX 78132 within thirty (30) days.
Conduct & Compliance. I will not engage in horseplay, racing, stunts, or any conduct not expressly authorized by staff. Staff may observe me for signs of impairment and may end my session at any time for any reason without refund.
Equipment Responsibility. I accept financial responsibility for damage to equipment caused by reckless operation, intentional misuse, ignoring staff instructions, or operating outside designated riding areas.
Medical Authorization. I authorize Divine Voltage staff to secure emergency medical treatment on my behalf if necessary, and I accept responsibility for all associated costs.
Recording & Evidence. I understand that sessions may be recorded by helmet, drone, shore, or handheld cameras for safety, training, and documentation, and that any such footage may be retained and used as evidence in connection with any incident or claim.
Weather & Cancellation. Divine Voltage may postpone, cancel, or terminate any activity whenever conditions are deemed unsafe, in its sole discretion.
Comprehension & Voluntariness. I read and understand English. I have had the opportunity to ask questions and to consult an attorney of my choosing. No one has pressured or hurried me. I understand I am free to decline to participate, and that I am giving up substantial legal rights.
Governing Law, Venue & Severability. This agreement is governed by the laws of the State of Texas. Exclusive venue for any dispute shall lie in the state or federal courts located in Comal County, Texas. If any provision is held unenforceable, it shall be reformed and enforced to the maximum extent permitted by law rather than struck, and all remaining provisions shall remain in full force. The host venue, property owner, and any additional insured named on Divine Voltage’s certificate of insurance for this session are intended third-party beneficiaries of this agreement and may enforce it directly.
Electronic Signature. A signature delivered electronically or by photograph, scan, or digital signature platform has the same force and effect as an original ink signature.
