Terms of Service

1. Agreement. These Terms of Service govern your access to and use of www.divinevoltage.com and any purchase from Divine Voltage LLC (“Divine Voltage,” “we,” “us”). By using this site or placing an order, you agree to these terms. If you do not agree, do not use the site.

2. Eligibility. You must be at least 18 years old to purchase from this site. By placing an order you represent that you are 18 or older and legally able to enter into this agreement.

3. Products and Pricing. We strive for accuracy in product descriptions, specifications, images, and pricing, but we do not warrant that such information is error-free. Specifications are provided by manufacturers and are subject to change without notice.

4. Pricing Errors and Order Acceptance. Your order is an offer to purchase. We reserve the right to accept, decline, or cancel any order for any reason, including product unavailability, errors in pricing or product information, or suspected fraud. If an order is cancelled after payment, we will issue a full refund. If a product is listed at an incorrect price, we may cancel the order even after confirmation.

5. Payment. Payment is due at the time of order unless otherwise agreed in writing. Deposits on special orders and pre-orders are subject to our Return and Cancellation Policy. You represent that you are authorized to use the payment method provided.

6. Shipping and Returns. All orders are subject to our Shipping Policy and our Return and Refund Policy, which are incorporated into these terms by reference.

7. Assumption of Risk. Electric surfboards, electric motorcycles, and related powersports equipment are inherently hazardous products. Their use involves risk of serious injury, permanent disability, or death, to the operator and to others. By purchasing, you acknowledge these risks and accept full responsibility for the safe operation, storage, maintenance, and supervision of the equipment, and for ensuring that any person you permit to use it is competent and appropriately supervised.

8. Operator Responsibility and Legal Compliance. You are solely responsible for complying with all federal, state, and local laws governing the operation of your equipment, including registration, titling, waterway and trail regulations, personal flotation device requirements, helmet and protective equipment requirements, minimum operator age, and any restrictions on where the equipment may be used. You are responsible for reading and following all manufacturer instructions, warnings, and safety materials.

9. Battery Safety. Lithium-ion battery packs present a risk of fire, thermal runaway, and serious property damage if damaged, improperly charged, improperly stored, or exposed to water intrusion or extreme temperatures. You agree to follow all manufacturer charging, storage, transport, and handling instructions. Divine Voltage is not responsible for damage or injury resulting from improper battery handling.

10. No Safety, Medical, or Legal Advice. Content on this site is provided for general informational purposes and does not constitute safety instruction, training, medical advice, or legal advice. Consult qualified professionals and the manufacturer’s documentation.

11. Warranty. New products are covered by the applicable manufacturer’s warranty. Divine Voltage LLC is an authorized dealer and will support and facilitate warranty claims, but warranty terms, coverage, and duration are determined by the manufacturer, not by Divine Voltage. EXCEPT AS EXPRESSLY PROVIDED, PRODUCTS AND SERVICES ARE PROVIDED “AS IS,” AND DIVINE VOLTAGE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIVINE VOLTAGE LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THE SITE, ANY PRODUCT, OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

13. Indemnification. You agree to indemnify, defend, and hold harmless Divine Voltage LLC and its owners, members, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your use or misuse of any product, your violation of these terms, or your violation of any law or the rights of a third party.

14. Events, Demonstrations, and Rentals. Participation in demonstrations, rentals, guided sessions, events, or experiences is governed by separate written agreements and waivers executed at or before the time of participation. These Terms of Service do not authorize participation in any such activity and do not replace those agreements.

15. Intellectual Property. All content on this site, including text, graphics, logos, images, and video, is the property of Divine Voltage LLC or its licensors and is protected by intellectual property law. You may not reproduce, distribute, or create derivative works without our written permission. Manufacturer trademarks are the property of their respective owners.

16. User Content. If you submit reviews, photos, video, or other content to us or tag us on social media, you grant Divine Voltage a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing purposes. You represent that you own or have the rights to any content you submit.

17. Third-Party Links. This site may link to third-party websites. We do not control and are not responsible for their content, products, or practices.

18. Privacy. Your use of this site is governed by our Privacy Policy.

19. Governing Law and Venue. These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Comal County, Texas, and you consent to personal jurisdiction and venue there.

20. Changes to These Terms. We may update these terms at any time. Changes are effective when posted. Your continued use of the site constitutes acceptance of the revised terms.

 

21. Severability. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
